Terms of Use

These Terms of Use (“Terms”) govern access to and use of the website at www.criminaldefence.sg (the “Website”), operated by Foxwood LLC (“Foxwood”, “the Firm”, “we”, “us” or “our”). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website.

1. Acceptance of Terms

1.1By accessing, browsing or otherwise using the Website, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

1.2We may amend these Terms from time to time in accordance with Clause 16. Your continued use of the Website after any such amendment constitutes your acceptance of the amended Terms.

2. About This Website

2.1The Website provides general information about Foxwood LLC and the areas of law in which the Firm practises, including criminal defence work relating to sexual offences and related matters.

2.2The Website is intended for informational purposes only and is directed at users based in Singapore. We make no representation that the content of the Website is appropriate, accurate or available for use in any other jurisdiction.

3. No Legal Advice; No Solicitor–Client Relationship

3.1The content on the Website, including all practice area pages, articles and frequently asked questions, is provided for general information only. It does not constitute legal advice and should not be relied upon as such.

3.2The law is complex, differs according to the specific facts of each case, and changes over time. Nothing on the Website should be treated as a substitute for specific legal advice from a qualified lawyer in respect of your own circumstances.

3.3Your use of the Website, including browsing its content, submitting an enquiry through our contact form, or contacting us by telephone, WhatsApp or email, does not by itself create a solicitor–client relationship between you and Foxwood LLC or any of its lawyers. A solicitor–client relationship is formed only when Foxwood LLC has expressly agreed to act for you, typically evidenced by a signed letter of engagement or warrant to act.

3.4Until a solicitor–client relationship has been formed in accordance with Clause 3.3, we are under no obligation to keep confidential any information you send to us, save to the extent required by law, and you should not send us any information you consider to be highly sensitive or privileged before speaking with us.

4. Confidentiality and Legal Privilege

4.1Communications sent through the Website’s contact form, or otherwise before a solicitor–client relationship is formed, may not attract legal professional privilege and may not be treated as confidential in the same way as communications with a retained lawyer.

4.2We recommend that you do not disclose highly sensitive, confidential or privileged information through the contact form. If your matter is urgent or sensitive, please contact us by telephone or WhatsApp to arrange a confidential discussion before providing further details in writing.

4.3Once you have formally engaged Foxwood LLC, all communications between you and the Firm will be subject to legal professional privilege and our professional duty of confidentiality, in accordance with the Legal Profession Act 1966 and the Legal Profession (Professional Conduct) Rules 2015.

5. Accuracy of Information; No Warranty

5.1We endeavour to keep the information on the Website accurate and up to date, but we make no representations or warranties of any kind, express or implied, as to the completeness, accuracy, reliability, suitability or availability of the Website or the information contained on it.

5.2The law, including statutes, subsidiary legislation and case law referred to on the Website, may change or develop after the relevant page was published. We are under no obligation to update the Website to reflect such changes, although we will endeavour to do so where practicable.

5.3The Website is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Limitation of Liability

6.1To the fullest extent permitted by law, Foxwood LLC, its partners, employees and agents shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or in connection with:

  • (a)your access to, use of, or inability to access or use the Website;
  • (b)any reliance placed on the content of the Website;
  • (c)any errors, mistakes or inaccuracies in the content of the Website; or
  • (d)any unauthorised access to or use of our servers and/or any personal information stored therein.

6.2Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under Singapore law.

7. Indemnity

7.1You agree to indemnify and hold harmless Foxwood LLC, its partners, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms or your misuse of the Website.

8. Intellectual Property Rights

8.1All content on the Website, including but not limited to text, graphics, logos, images and the design and layout of the Website, is the property of Foxwood LLC or its licensors and is protected by Singapore and international intellectual property laws, unless otherwise indicated.

8.2You may not reproduce, republish, distribute, or create derivative works from any content on the Website without our prior written consent.

8.3“Foxwood LLC” and any associated logos are trademarks of Foxwood LLC. Nothing on the Website should be construed as granting any licence or right to use any trademark without our prior written permission.

9. Acceptable Use

9.1You agree not to use the Website:

  • (a)in any way that breaches any applicable local, national or international law or regulation;
  • (b)to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material;
  • (c)to attempt to gain unauthorised access to, interfere with, damage or disrupt any part of the Website, the server on which it is hosted, or any equipment or network connected to it;
  • (d)to introduce any viruses, trojans, worms, or other material which is malicious or technologically harmful; or
  • (e)to scrape, harvest or otherwise extract data from the Website by automated means without our prior written consent.

10. Submissions and Enquiries

10.1When you submit an enquiry through our contact form or otherwise contact us, you agree to provide accurate and complete information.

10.2We may use the information you provide to respond to your enquiry, to assess whether we are able to act for you, and for the other purposes set out in our Privacy Policy.

10.3We reserve the right, in our sole discretion, to decline to act for any prospective client, including where doing so would give rise to a conflict of interest.

10.4Submitting an enquiry to us through the Website’s contact form, WhatsApp, email or telephone does not create any obligation on our part to respond. While we aim to respond to enquiries promptly, we may, in our sole discretion, decline to respond to any enquiry.

11. Third-Party Links and Content

11.1The Website may contain links to third-party websites or resources, such as legislation portals or the Sentencing Advisory Panel. These links are provided for your convenience only.

11.2We have no control over the content of third-party websites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply our endorsement of the linked website.

12. Privacy

12.1Our collection, use and disclosure of personal data through the Website is governed by our Privacy Policy, which forms part of these Terms.

13. Availability of the Website

13.1We do not guarantee that the Website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw, or restrict the availability of all or part of the Website for business or operational reasons, including maintenance, without notice.

14. Governing Law and Dispute Resolution

14.1These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Singapore.

14.2The courts of Singapore shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

15. Severability

15.1If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

16.1We may revise these Terms at any time by updating this page. Please check this page periodically to ensure you are aware of any changes. The “Last updated” date at the bottom of this page indicates when these Terms were last revised.

17. Entire Agreement

17.1These Terms, together with our Privacy Policy, constitute the entire agreement between you and Foxwood LLC in respect of your use of the Website and supersede all prior agreements and understandings, whether written or oral, relating to such use.
