What happens when the police investigate you in Singapore?

When the police investigate, they gather evidence to decide whether to bring a charge, taking statements from you and other witnesses, seizing items such as phones, and obtaining CCTV footage etc. You may be asked to attend at a police station, give your statement, and/or hand over your devices. An investigation can run for weeks or months with little told to you in between. Because what you say and do now can shape everything that follows, this is the stage at which our advice tends to matter most.

Do I have to give a statement to the police?

Accepted Answer

If the police require a statement, you are obliged to cooperate and to state truthfully what you know (section 22 of the Criminal Procedure Code). You need not say anything that might expose you to a criminal charge. There is privilege against self-incrimination. Knowing where that line falls is rarely obvious under pressure, and getting it wrong can be costly. If you have a defence, not providing it at an early stage can cast doubts on it if you only raise it later. Many of our clients speak to us before they attend.

Do I need a lawyer before giving a police statement?

Accepted Answer

There is no rule requiring it, but it is often wise. A statement, once signed, cannot be undone and it can become the central evidence in your case. Before you give one, we can help you understand your obligations, your right to silence, and the weight of what you say. That guidance is hard to replace once the statement is recorded.

Can my lawyer come with me to give a statement?

Accepted Answer

No. This is not an American TV drama. Lawyers in Singapore are not permitted to be present during your arrest or the recording of your statement. You have a constitutional right to a lawyer within a reasonable time, but that consultation only happens after the initial arrest, not in the interview room. That is exactly why the advice you take from us beforehand is so valuable.

Can I refuse to answer police questions?

You have a privilege against self-incrimination and need not say anything that might expose you to a criminal charge (section 22(2) of the Criminal Procedure Code). However, once you are notified of the charge you may face, failing to mention something you later rely on in your defence can count against you (section 23). When to speak and when to stay silent is a judgment call, and it is one we can help you make.

What is a cautioned statement?

Accepted Answer

A cautioned statement is taken under section 23 of the Criminal Procedure Code once the police decide to charge you. You are given a written notice setting out the charge and warning that if you stay silent now about something you later rely on in your defence, the court may hold that against you, ie. the "caution". It is your chance to put your defence on record. What goes into it can matter a great deal, which is why we would want to help you prepare it.

Can the police take my phone, and do I have to give my password?

Accepted Answer

Yes. The police have wide powers to seize devices and to require access to your data, including the passwords or information needed to unlock or decrypt them. Refusing without lawful excuse can itself be an offence. If you are unsure what you are actually required to hand over, that is a question to put to us quickly.

Can I be arrested without a warrant?

Accepted Answer

It depends on the offence. For "arrestable" offences (which include many serious and sexual offences), the police may arrest you without a warrant; for "non-arrestable" offences they generally need one first. A warrant is not required for offences such as rape, sexual assault by penetration or outrage of modesty (molest). What are my rights when I am arrested?

On arrest you must be told the grounds of your arrest, and you have the right to consult a lawyer (Article 9 of the Constitution). It is, however, not an immediate right.

You may ask to contact your family, and you cannot be forced to sign a statement you disagree with. You have the right to amend any statement you give. You also have the right to ask for an interpreter if you prefer giving your statement in a language other than English.

How long can the police investigate before deciding whether to charge me?

Accepted Answer

Upon arrest, you must be brought to court and be charged within 48 hours. Otherwise, you may be released from the police station. You may be placed on police bail upon your release.

The subsequent investigations do not have a fixed time limit. Some investigations run for many months, often with you on bail throughout. The uncertainty is one of the hardest parts of the process. In the meantime, we can engage with the authorities on your behalf, make representations, and help you understand where things stand.

What happens after I am arrested in Singapore?

After arrest you may be held for questioning. As a general rule, if you are not released earlier, you must be brought before a court within 48 hours, and the question of bail or remand is dealt with there. These first hours move quickly, and the decisions taken in them can matter for the rest of the case. The sooner we are involved, the more we can do.

What is the difference between a bailable and a non-bailable offence?

For a bailable offence you have a right to be released on bail (section 92 of the Criminal Procedure Code). For a non-bailable offence (which includes many serious and sexual offences, such as rape), bail is not automatic; it is granted at the discretion of the police or the court (section 93). "Non-bailable" does not mean bail is impossible; it means a judge has to be persuaded to grant it, which is where our advocacy counts.

Can I get bail for a sexual offence?

Often, but not always, and not as of right. Many sexual offences are non-bailable, so bail becomes a matter of discretion, and a small category of the most serious offences may attract no bail at all (section 95 of the Criminal Procedure Code). What is the difference between police bail and court bail?

Police bail is offered while investigations continue, before you are charged in court; court bail is set once you are charged and brought before a judge. The conditions can differ.

How is the bail amount decided?

Accepted Answer

The amount is set at the discretion of the police or the court, weighing the seriousness of the offence, the risk of you absconding or interfering with witnesses, and your ties to Singapore. It is meant to secure your attendance, not to punish you. Because the figure and conditions are open to argument within limits, how your circumstances are put forward can affect the result. That is something we can take on for you.

What conditions can be attached to bail?

Accepted Answer

Common conditions include surrendering your passport, committing no further offence, not contacting or interfering with witnesses, reporting to a police station, attending court whenever required (section 94 of the Criminal Procedure Code), e-tagging. It is usually a combination of these. Further conditions can be added depending on the case. Each carries consequences if breached, so it is worth understanding exactly what the bailor's obligations are.

Who can be a bailor, and what are their responsibilities?

Accepted Answer

A bailor (surety) must usually be a Singapore citizen or permanent resident, at least 21 years old, not a bankrupt, and not the accused or a co-accused. The bailor pledges the bail sum and undertakes to ensure you attend court. For bail below $15,000, cash is not usually required. The bailor signs to confirm that he or she holds assets of at least the bail amount, without having to produce them. Where bail is above $15,000, those assets generally have to be shown. If you abscond, the bailor can be made to pay the sum pledged.

What happens if I breach my bail conditions?

Breaching bail (by missing court, contacting a witness, or trying to leave the country without permission) can lead to your arrest, forfeiture of the bail sum, and stricter conditions or remand, and it can harm your standing in the case. What is the difference between being investigated and being charged?

Being investigated means the police are still gathering evidence and no formal accusation has been brought; being charged means the Prosecution has formally accused you of a specific offence and your matter is fixed for attendance in court. Not every investigation leads to a charge. What happens in between, including representations to the Prosecution, can influence whether, and what, you are charged. That window is one we can use to your advantage.

What happens at the first mention in court?

At the first mention the charge is read and you are told what you are accused of. You are usually not required to decide whether to plead guilty or claim trial on the spot. You can ask for time to seek legal advice, and the matter is often adjourned.

A charge sheet is the document setting out the offence you are accused of. The precise wording matters: it affects the possible penalties and how the case can be defended. We examine whether a charge is correctly framed, and whether it can be challenged or reduced.

A pre-trial conference is a procedural hearing where the court manages the case: timelines, the disclosure of evidence, and whether the matter will proceed as a plea or a trial. What are representations to the Prosecution, and when are they made?

Representations are formal written submissions to the Prosecution (the Attorney-General's Chambers) asking it to reduce, amend, or withdraw a charge, or to take a particular position on sentence. They can be made before or after a charge is brought. Well-prepared representations can change the shape of a case, sometimes significantly. We have obtained favourable outcomes for some clients when representations are made before one is charged in court.

Can a charge be reduced, withdrawn, or dealt with by a warning?

Yes, in appropriate cases. The Prosecution may reduce or withdraw a charge, or deal with a matter by way of a warning, depending on the facts, the strength of the evidence, and any representations made. We can assess whether your case is a candidate and make that case for you.

What is a conditional warning, and is it a conviction?

Accepted Answer

A conditional warning is a formal warning issued instead of prosecution, on condition that you do not reoffend within a set period. It is not a conviction and brings no court sentence. However, if you breach the condition, you can be prosecuted for the original offence and the new offence. Whether a warning is appropriate, and how to seek one, is something we can advise on.

What is compounding an offence?

Compounding (also called composition) is a way of resolving certain minor offences without a conviction, where the victim agrees to settle the matter, often in return for an apology and compensation. Where investigations have begun or you have been charged, the Prosecution's consent is needed (section 241 of the Criminal Procedure Code).

What offences can be compounded?

Only those the law specifically allows, generally offences that are more minor and private in nature. The offences a victim may compound are listed in the Fourth Schedule to the Criminal Procedure Code, and include, for example, insulting the modesty of a woman (section 509 of the Penal Code). More serious offences cannot be compounded. Whether your particular charge qualifies, and whether composition is realistic, requires specific legal advice for your situation.

Can a sexual offence charge be settled or compounded?

Usually not. Most sexual offences are too serious to be compounded; the main exception in this area is insulting the modesty of a woman (section 509 of the Penal Code), which a victim may agree to compound, subject to the Prosecution's consent once investigations are underway. Whether anything along these lines is even possible in your case depends on the precise charge and the facts. This is exactly the sort of thing to explore with us rather than assume.

Should I plead guilty or claim trial?

This is one of the most important decisions in a criminal case, and it should never be made lightly or alone. Pleading guilty means admitting you are guilty ("I did it"). It brings the case to a close and may be treated as a mitigating factor, but it means accepting a conviction. Claiming trial means denying you are guilty ("I did not do it" or "I have a defence"). Generally, the Prosecution must prove its case against you. The choice depends on your specific factual circumstances, which is why this decision, above all, is one to make with the help of legal advice.

How long does a criminal case usually take?

It varies widely. A straightforward plea may be dealt with across a few mentions within six months; a contested trial can take a year or more. Much depends on the complexity of the case and the court's schedule. As lawyers, we can give you a realistic sense of the likely timeline once we understand your case.

What happens when you plead guilty in Singapore?

When you plead guilty, the Prosecution reads out a Statement of Facts setting out what you are said to have done. If you admit those facts without qualification, the court records your plea, convicts you, and then hears mitigation before passing the sentence (section 227 of the Criminal Procedure Code). Because a plea has lasting consequences, it is a step we would always want to take you through first.

What is a statement of facts, and what if I disagree with part of it?

The Statement of Facts is the Prosecution's account of the offence, which you are asked to admit before you are convicted. If you disagree with something important in it, you should not simply accept it. A dispute over the facts can change the sentence, and may need to be resolved by the court. This may require going to a Newton Hearing. Going through the Statement of Facts carefully with you, before you admit it, is part of what we do.

What is a plea in mitigation?

A plea in mitigation is your opportunity, after conviction, to put forward sentencing precedents and circumstances that may persuade the court to impose a lighter sentence. A thoughtful, well-researched mitigation can make a material difference to the outcome, and preparing one persuasively is a large part of our work.

Does pleading guilty reduce the sentence?

Accepted Answer

Yes. Based on the guidelines issued by the Sentencing Advisory Panel (https://www.sentencingpanel.gov.sg/), an early plea of guilt can result in a discount of up to 30%. Indicating a plea of guilt later affects the maximum sentencing discount. The reduction is not fixed or guaranteed, and how it applies depends on the case. We always advise on when to enter your plea.

Will I definitely go to jail if I plead guilty?

Not necessarily. Whether imprisonment follows depends on the offence and its seriousness. The honest answer is that it varies, and a realistic view of your own case is something we can give you once we have seen the details.

Can I be sentenced to something other than jail?

Accepted Answer

Yes, depending on your age and the charge(s). Alongside imprisonment, caning, and other penalties, the courts have a range of options: fines, community-based sentences, day reporting, short detention or mandatory treatment orders, and, for younger offenders, probation or reformative training. Which are realistically open to you depends on your age and the charge(s), and identifying and arguing for the right one is something we can do for you.

What happens at a criminal trial in Singapore?

At trial, the Prosecution calls its evidence and witnesses, who can be cross-examined, and you may then give your own evidence and call your witnesses. You and your witnesses can also be cross-examined by the Prosecution. After submissions, the court decides whether the charge has been proved. A trial is demanding and follows strict rules of procedure and evidence. That is why having us conduct it on your behalf matters.

Who has to prove the case, and to what standard?

The Prosecution generally bears the burden of proving the charge, and must do so beyond a reasonable doubt. There are certain exceptions for some offences. How effectively the Prosecution's evidence is tested can determine whether that high standard is met, and testing it rigorously is at the heart of what we do at trial.

It is the high standard of proof the Prosecution must reach before you can be convicted: the court must be sure of guilt, not merely think it likely. If a reasonable doubt remains, the charge is not made out. Identifying and drawing out those doubts in the evidence is central to a defence, and to our role in conducting one.

What is the difference between examination-in-chief and cross-examination?

Examination-in-chief is when a party questions its own witness to bring out their account; cross-examination is when the opposing party questions that witness to test it and expose weaknesses. In a contested trial, usually yes. The complainant generally has to testify and can be cross-examined on their account. How that evidence is tested, carefully and appropriately, can be decisive. This is sensitive and skilled work, and it is something we are experienced in handling.

If the court is not satisfied that the charge has been proved beyond a reasonable doubt, you can be acquitted and the charge is dismissed. However, the charge may also be amended and you can be convicted on the amended charge. An acquittal brings the case to an end, subject to any appeal by the Prosecution. Working towards that outcome is what a defence at trial is for.

Aggravating factors make an offence more serious and tend to increase the sentence. For example, an abuse of trust, use of violence, or the vulnerability of a victim. General deterrence aims to discourage the public at large from committing similar offences; specific deterrence aims to discourage the particular offender from reoffending. For many offences, deterrence weighs heavily in sentencing.

Can I be caned, and who cannot be caned?

Accepted Answer

Caning is a possible punishment for certain offences, but it cannot be imposed on women, on men above 50 years of age at the time of sentencing, or on a person sentenced to death. If a man is above 50 years of age, the court may impose an additional imprisonment in lieu of caning. Whether it applies in your case depends on the offence and your circumstances, which we can advise you on.

Can I get probation?

Probation is a rehabilitative sentence that keeps an offender in the community under supervision instead of in prison. It is most readily available to young offenders, ie. below 21 years of age. Adults may be considered, but this is rare and generally only for less serious offences. Whether it is open to you in your case is something we can assess.

When is a community-based sentence available?

Community-based sentences such as community service, short detention, day reporting or mandatory treatment orders allow the court to deal with suitable cases without full imprisonment. They are generally reserved for less serious offences and upon meeting specific requirements. They are not available for serious offences. How are sentences for multiple charges combined, and what is the difference between concurrent and consecutive sentences?

Where you are sentenced for more than one offence, the court decides whether the individual sentences run concurrently (at the same time) or consecutively (one after another), and where there are three convictions with imprisonment terms, at least two must run consecutively. The court then steps back to ensure the total sentence is not excessive. How these sentences are structured can significantly affect the time served, and it is something we make submissions on.

When does my sentence start, and can it be backdated for time spent in remand?

An imprisonment sentence generally takes effect on the day it is passed (section 318 of the Criminal Procedure Code). Where you were held in custody before sentencing, the court can backdate the sentence, or take that remand time into account. Making sure any time already served is properly reflected is something we raise on your behalf.

How much of my sentence will I actually serve?

In practice, many prisoners do not serve the full term. Under the Conditional Remission System, an inmate who behaves well is usually released after serving two-thirds of the sentence, subject to conditions for the remainder. In certain cases, one can be eligible for home detention and may be released even before two-thirds of the sentence is served.

What is the Conditional Remission System?

It is the scheme under the Prisons Act by which most inmates, on good behaviour, are released after serving two-thirds of their sentence under a Conditional Remission Order. The basic condition is that you do not commit a further offence during the remission period; if you do, the unserved portion can be added back to a fresh sentence. Can I serve part of my sentence at home under the Home Detention Scheme?

Possibly, but not as of right. The Home Detention Scheme, under the Prisons Act, allows eligible inmates to serve the tail end of their sentence at home under monitoring and strict conditions. How do I appeal, and how long do I have to file an appeal?

If you wish to challenge your conviction, your sentence, or both, you have 14 days from the decision to file a notice of appeal. The deadline is strict and the grounds must be properly framed, so time is of the essence. The sooner we can review your case, the better placed we are to advise on whether an appeal is worthwhile and how to prepare it.

Can I be released on bail pending appeal?

Sometimes. The court has a discretion to grant bail while an appeal is pending, but it is not automatic, particularly for more serious offences and custodial sentences. Will I have a criminal record, and can it ever become spent?

A conviction for a registrable offence results in a criminal record. Some records can later become "spent" (treated as cleared) after a crime-free period of five years, but this is not open to everyone: it is unavailable where the offence is a serious one listed in the law, or where the sentence exceeded three months' imprisonment or a fine of more than $2,000, among other disqualifications (the Registration of Criminals Act). Many sexual offences will not qualify automatically. We can advise on where your case is likely to fall.

A conviction can have consequences well beyond the sentence: for professional licensing and employment, for permanent residence, and for travel or visa applications to other countries, each of which has its own rules. Can I be charged under Singapore law if I am a foreigner or a tourist?

Yes. Singapore's criminal law applies to anyone who commits an offence here, regardless of nationality or immigration status. As a foreigner you have the same right to defend yourself, and to be represented, as anyone else. Because a charge here also carries immigration consequences, having us involved early is particularly important for foreign clients.

Will my passport be impounded while I am under investigation or on bail?

Very likely. Surrendering your passport is a standard condition of bail, and it is commonly required during investigations too, to ensure you remain contactable and attend court.
